1. Acceptance of Terms

By accessing or using the DialBits platform and services provided by Developers Alliance ("we", "us", or "our"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

2. Description of Services

DialBits provides AI-powered voice automation solutions for customer operations, including but not limited to debt collection, customer support, and sales automation. Our services are offered on a subscription or usage-based basis as agreed upon in your service agreement.

3. Eligibility

You must be at least 18 years old and have the legal authority to enter into this agreement on behalf of yourself or your organization. By using our services, you represent and warrant that you meet these requirements.

4. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to comply with this obligation.

5. Acceptable Use

You agree not to use DialBits services to:

  • Violate any applicable local, national, or international laws or regulations
  • Engage in any fraudulent, deceptive, or misleading communication
  • Harass, abuse, or harm any individual
  • Transmit unsolicited commercial communications in violation of applicable law
  • Interfere with or disrupt the integrity or performance of our services

6. Intellectual Property

All content, technology, software, and materials related to DialBits are the exclusive property of Developers Alliance or its licensors. You are granted a limited, non-exclusive, non-transferable license to use our services solely for your internal business purposes. You may not copy, modify, distribute, or reverse-engineer any part of our platform.

7. Data and Privacy

Your use of DialBits is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the collection and use of your data as described in the Privacy Policy. We take industry-standard measures to protect your data, but cannot guarantee absolute security.

8. Payment and Billing

Fees for our services are set out in your service agreement or as published on our website. All fees are non-refundable unless otherwise stated. We reserve the right to suspend or terminate your access if payment obligations are not met within the agreed timeframe.

9. Limitation of Liability

To the fullest extent permitted by law, Developers Alliance shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the DialBits services. Our total liability shall not exceed the amount paid by you in the three (3) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Developers Alliance, its affiliates, officers, employees, and agents from any claims, losses, damages, or expenses (including reasonable legal fees) arising out of your use of the services, your violation of these Terms, or your violation of any third-party rights.

11. Termination

We reserve the right to suspend or terminate your access to DialBits at any time, with or without cause, and with or without notice. Upon termination, all licenses granted to you under these Terms will immediately cease.

12. Changes to Terms

We may update these Terms and Conditions from time to time. We will notify you of significant changes via email or through the platform. Your continued use of the services after changes are posted constitutes your acceptance of the revised terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Developers Alliance is registered, without regard to its conflict of law provisions.
